1. About SmartBaskt

SmartBaskt is a mobile application that uses artificial intelligence to identify grocery products in your shopping cart and find available coupons at participating retailers. SmartBaskt is operated by SmartBaskt LLC ("we," "us," or "our").

2. Eligibility

You must be at least 13 years old to use SmartBaskt. By creating an account, you confirm that you meet this age requirement. If you are under 18, you confirm that you have parental or guardian consent to use the app.

3. Your Account

When you create a SmartBaskt account:

• You are responsible for keeping your password secure
• You are responsible for all activity that occurs under your account
• Your username is permanent and cannot be changed after account creation
• You may not create accounts for others or use someone else's account
• You must provide accurate information when creating your account

4. Acceptable Use

You agree to use SmartBaskt only for its intended purpose of finding grocery coupons. You agree not to:

• Use the app for any illegal purpose
• Attempt to reverse engineer, hack, or compromise the app or its systems
• Use automated tools to access the app at scale
• Create fake accounts or impersonate others
• Upload images that are illegal, harmful, or unrelated to grocery shopping
• Attempt to circumvent scan limits or other usage restrictions

5. Coupon Accuracy

SmartBaskt strives to provide accurate and current coupon information. However:

• Coupons are subject to change or expiration at any time by the retailer or manufacturer
• We do not guarantee that any coupon will be accepted at checkout
• Coupon availability may vary by store location
• During our beta phase, some coupons are AI-generated estimates and may not reflect actual available offers
• SmartBaskt is not responsible for any coupon being declined at the register

6. Data Collection and Use

By using SmartBaskt, you consent to our collection and use of your data as described in our Privacy Policy. This includes the collection of your shopping behavior data, which may be shared in anonymized and aggregated form with third parties including brands and retailers. You acknowledge and agree that SmartBaskt may monetize aggregated, anonymized shopping data derived from your use of the app.

7. Free Tier Limitations

Free accounts are limited to 5 cart scans per day. We reserve the right to change scan limits at any time with reasonable notice. Premium features, when available, will be offered through a paid subscription.

8. Intellectual Property

SmartBaskt and all its content, features, and functionality are owned by SmartBaskt LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the app without our written permission.

9. Disclaimer of Warranties

SmartBaskt is provided "as is" without warranty of any kind. We do not warrant that the app will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranties about the accuracy or completeness of coupon information.

10. Limitation of Liability

To the maximum extent permitted by law, SmartBaskt LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including but not limited to loss of savings, data, or business opportunities. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. You may delete your account at any time through the app's profile settings. Upon termination, your right to use SmartBaskt immediately ceases.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by email or through the app. Your continued use of SmartBaskt after changes are posted constitutes acceptance of the updated terms.

13. Governing Law

These Terms of Service are governed by the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Georgia.
